By accessing or using this Platform, you agree to these Terms of Use and the accompanying Legal Disclaimer. If you do not agree, please discontinue using the Platform immediately.

2. Purpose of the Platform - Educational Only

The Platform provides educational content about food ingredients, safety insights, and nutritional information based on:

• Publicly available or user-submitted ingredient data
• Food labeling information
• General guidelines issued by authorities such as the Food Safety and Standards Authority of India (FSSAI), World Health Organization (WHO), and other scientific references

While Mittieco Tech strives for accuracy, the Platform's results are generated using:

5. No Claims, No Endorsements, No Certifications

5.1 Brand and Product References

The Platform may analyze or display results for packaged food products. Any mention of brand names, trademarks, or product references:

• Does not imply endorsement, affiliation, criticism, approval, or disapproval
• Is based entirely on publicly available ingredient data or user-provided information
• Does not represent a factual claim about the product's quality, safety, or healthiness

• Your violation of any third-party rights, including intellectual property rights
• Any decisions made based on Platform outputs
• Your breach of any applicable laws or regulations

This indemnification obligation survives termination of these Terms and your use of the Platform.

• Google Cloud Vision API (for OCR)
• Firebase (for data storage and authentication)

Mittieco Tech is not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

13. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of India, including but not limited to:

• Information Technology Act, 2000 and Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
• Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020
• Food Safety and Standards Act, 2006 and Rules thereunder
• Indian Contract Act, 1872
• Copyright Act, 1957

Without prejudice to the mandatory provisions of the Consumer Protection Act, 2019, all users expressly agree that any disputes shall be resolved as per Section 15 (Dispute Resolution) below.

14. Dispute Resolution and Arbitration

14.1 Pre-Arbitration Negotiation

Before initiating arbitration, parties agree to attempt good-faith negotiations for a period of 30 (thirty) days from the date a written notice of dispute is sent to:

If negotiations fail, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the following terms:

• Number of Arbitrators: One (1) sole arbitrator
• Appointment: Mutually agreed upon by both parties within 15 days. If no agreement, appointed by the Chairman of the Bar Council of Odisha
• Seat of Arbitration: Bhubaneswar, Odisha, India
• Language: English and/or Hindi
• Governing Rules: Arbitration and Conciliation Act, 1996
• Arbitration Costs: Each party bears its own costs unless the arbitrator determines otherwise

14.3 Consumer Rights Protection

14.4 Court Jurisdiction (Post-Arbitration)

Subject to the arbitration clause above, any legal proceedings (including enforcement of arbitral awards or matters excluded from arbitration) shall be subject to the exclusive jurisdiction of the courts in Bhubaneswar, Odisha, India.

14.5 Exceptions to Arbitration

Either party may seek interim or injunctive relief in a court of competent jurisdiction for:

• Intellectual property violations
• Breach of confidentiality obligations
• Urgent matters requiring immediate court intervention

14.6 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action.

Mittieco Tech shall not be liable for any delay, failure, or interruption in providing the Platform services resulting from causes beyond its reasonable control, including but not limited to:

• Acts of God (earthquakes, floods, storms, pandemics, epidemics)
• War, terrorism, civil unrest, riots, or government actions
• Labor disputes or strikes
• Internet or telecommunications failures
• Cyber-attacks, denial-of-service attacks, or hacking
• Power outages or equipment failures
• Changes in laws or regulations

During a force majeure event, Mittieco Tech's obligations shall be suspended for the duration of such event. Mittieco Tech shall make reasonable efforts to notify users and resume normal operations as soon as practicable.

Mittieco Tech reserves the right to suspend or terminate your access to the Platform, with or without notice, for any of the following reasons:

• Violation of these Terms of Use
• Fraudulent, abusive, or harmful behavior
• Providing false or misleading information
• Unauthorized use or access attempts
• Legal requirements or court orders
• Protection of Mittieco Tech's rights or interests

18.1 Effect of Termination

Upon termination:

• All licenses and rights granted to you shall immediately cease
• You must discontinue all use of the Platform
• Sections 3, 6, 9, 11, 13, 14, 15, and 20 shall survive termination

19. Entire Agreement and Amendment

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Mittieco Tech regarding the use of the Platform.

These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Mittieco Tech.

19.1 Amendment Procedure

Mittieco Tech may modify these Terms at any time. For material changes:

• Users will be notified via email (if provided) or prominent notice on the Platform
• A 30-day notice period will be provided before changes take effect
• Continued use after the notice period constitutes acceptance of modified Terms

20. Waiver

No waiver by Mittieco Tech of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
